General Terms and Conditions of Sale

1. Scope

These General Terms and Conditions of Sale (GTC) govern the sale of gift vouchers offered by MOLM through its online platform.

Any order placed on the platform implies the buyer's full and unconditional acceptance of these GTC.

Gift vouchers are intended for private individuals as well as professionals, unless otherwise stated.

3. Service description

MOLM sells gift vouchers redeemable with a network of partners listed on the platform.

Gift vouchers represent a monetary value that can be used to pay for all or part of a service or product offered by a partner participating in the MOLM programme.

The list of partners may change during the validity period of the gift voucher.

4. Order and conclusion of contract

The presentation of gift vouchers on the platform constitutes an invitation to contract and not a legally binding offer.

The contract is concluded when MOLM confirms the order by email after receipt of payment.

A summary confirmation of the order is sent to the buyer by email.

5. Pricing and payment

Prices displayed are in euros and include all applicable taxes.

Payment may be made by the payment methods offered at the time of ordering.

The gift voucher is issued only after payment has been validated.

6. Delivery of the gift voucher

The gift voucher is delivered in electronic format to the email address provided at the time of ordering.

Where this option is offered, a physical version may also be sent to the address provided by the buyer.

MOLM cannot be held liable for errors in the recipient's contact details.

7. Validity and use of gift vouchers

Gift vouchers are valid for a period of two (2) years from their date of issue, unless otherwise stated on the gift voucher.

Gift vouchers:

  • may not be exchanged for cash;
  • do not entitle the holder to change, unless otherwise agreed by the partner;
  • may be used in one or more instalments according to the terms defined by MOLM;
  • are transferable to a third party unless otherwise stated.

The beneficiary must present the corresponding code or document at the time of use.

8. Right of withdrawal

In accordance with applicable consumer protection regulations, the buyer has fourteen (14) days to exercise their right of withdrawal from the date of conclusion of the contract.

However, if the gift voucher has been used, even partially, before the expiry of this period, the right of withdrawal can no longer be exercised.

Refunds are made using the same payment method as used at the time of purchase, unless otherwise agreed.

9. Partners and liability

MOLM acts exclusively as an intermediary in the sale of gift vouchers.

Services and products obtained through gift vouchers are provided directly by the relevant partners, who remain solely responsible for their performance, quality and compliance.

MOLM cannot be held liable for damages, cancellations, postponements or failures attributable to a partner.

In the event of a partner ceasing operations or withdrawing from the network, MOLM may offer an alternative solution enabling the gift voucher to be used with another participating partner.

10. Data protection

Personal data collected in connection with orders is processed in accordance with MOLM's Privacy Policy and the General Data Protection Regulation (GDPR).

11. Applicable law and jurisdiction

These GTC are governed by Luxembourg law.

Any dispute relating to their interpretation or performance falls under the jurisdiction of the Luxembourg courts, subject to mandatory provisions protecting consumers.
